1. Who We Are

DRACHM is an independent apparel brand operated by an individual based in São Paulo, Brazil (the "Operator"). In these Terms, "DRACHM," "we," "us," and "our" refer to the Operator. You can reach us at any time at support@drachmarchive.com.

2. Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order. If you are under that age, you may use the Site only with the involvement of a parent or legal guardian.

3. Print-on-Demand Products

Every item is made to order. Once you place an order, it is printed, packed, and shipped by our third-party production and fulfillment partners. Because of this, production begins shortly after your purchase and your order cannot be held, altered, or combined once it has entered production.

We do our best to display product colors and print placement accurately, but colors may vary slightly depending on your screen, the garment, and the printing process. Please check the size guide on each product page before ordering. Small variations in print position, color, and garment dimensions are a normal part of the process and are not considered defects.

4. Orders, Pricing & Payment

All prices are listed in U.S. dollars (USD). Payments are processed securely by Stripe; we never see or store your full card details.

Placing an order is an offer to buy. Because every item is made to order and sent to production shortly after checkout, orders generally cannot be canceled or changed once placed (see our FAQ). We may refuse or cancel any order, including in cases of suspected fraud, unavailable products, or errors in pricing or product information. If we cancel an order after payment, we will issue a full refund to your original payment method.

Prices and availability may change at any time without notice, but changes will not affect orders already confirmed.

We ship within the United States and to many international destinations. Shipping costs for international orders are paid by the customer and shown at checkout. International orders may be subject to customs duties, import taxes, or fees charged by the destination country; these are the customer's responsibility unless collected at checkout.

5. Shipping, Returns & Refunds

Shipping times, costs, and destinations are described in our Shipping Policy. Returns, exchanges, and refunds are governed by our Refund & Return Policy. Both policies form part of these Terms.

6. Intellectual Property

All designs, artwork, text, graphics, logos, and other content on the Site are owned by DRACHM or used with permission, and are protected by copyright and other intellectual property laws. Buying a product gives you ownership of that physical item only; it does not grant you any right to reproduce, sell, or otherwise use the designs.

You may not copy, reproduce, modify, distribute, or commercially exploit any content from the Site without our prior written permission.

7. Use of the Site

You agree not to misuse the Site, including by attempting to gain unauthorized access, interfering with its operation, using automated tools to scrape or copy content, submitting false orders or payment information, or using the Site for any unlawful purpose.

8. Disclaimers

The Site and its content are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Site will always be available, uninterrupted, or error-free.

9. Limitation of Liability

To the fullest extent permitted by law, DRACHM will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or our products. Our total liability for any claim related to an order will not exceed the amount you paid for that order.

Some jurisdictions do not allow certain warranty exclusions or limitations of liability, so some of the above may not apply to you. Nothing in these Terms limits any rights you have under consumer protection laws that cannot be waived by contract.

10. Indemnification

You agree to indemnify and hold DRACHM harmless from any claims, losses, or expenses (including reasonable legal fees) arising from your violation of these Terms or your misuse of the Site.

11. Resolving Problems

Most issues can be solved quickly by talking to us. If you have a problem with an order or any concern about these Terms, please email us at support@drachmarchive.com with your order number and a description of the issue before opening a payment dispute or taking any other action. We will respond and work in good faith to resolve the matter within 30 days.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of the Federative Republic of Brazil, without regard to conflict-of-law principles. Subject to any mandatory rights you may have under the laws of your place of residence, any dispute arising from these Terms or your purchase will be submitted to the courts of the city of São Paulo, State of São Paulo, Brazil.

13. Changes to These Terms

We may update these Terms from time to time. The revised version will be posted on this page with an updated "Last updated" date. The Terms in effect at the time of your purchase apply to that order.

14. General

If any part of these Terms is found to be unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any provision is not a waiver of our right to do so later. These Terms, together with the policies referenced above, are the entire agreement between you and DRACHM regarding the Site and your purchases.
